Terms of Service

1. Agreement to Terms

By accessing or using the services of XHUMA Healthcare Ltd. ("XHUMA", "we", "our", or "us"), you (the "Client") agree to be bound by these Terms of Service. If you do not agree to these terms, you must not use our platform or services.

2. Description of Services

XHUMA provides cloud-based healthcare management tools including but not limited to:

  • Appointment scheduling and billing
  • Electronic patient health records
  • Claims and insurance management
  • Licensing board portals

These services are delivered through a web-based and mobile-accessible platform hosted on Oracle Cloud Infrastructure.

3. Account Registration and Responsibilities

Clients must:

  • Provide accurate and complete registration information
  • Maintain the confidentiality of login credentials
  • Be responsible for all activity conducted under their account

XHUMA reserves the right to suspend or terminate access in the event of a breach of these obligations.

4. Data Ownership and Use

Clients retain full ownership of all patient and administrative data entered into the system. XHUMA will not access, use, or share client data except:

  • As necessary to provide and maintain services
  • As required by law
  • With express written consent from the Client

5. Security and Privacy

XHUMA implements industry-standard security protocols including:

  • AES-256 and SSL encryption
  • Role-based access control and audit trails
  • Multi-layered backup and disaster recovery

All data is handled in accordance with our Privacy Policy and applicable data protection laws.

6. Service Availability

XHUMA will use commercially reasonable efforts to ensure the continuous availability of the platform. However, XHUMA does not guarantee uninterrupted service and will not be liable for any downtime due to maintenance, updates, or force majeure.

7. Payment and Billing

Fees and billing cycles are specified in the Client’s individual service agreement. Invoices are due within the time specified on each invoice. Late payments may result in service suspension.

8. Cancellation and Termination

Either party may terminate the agreement with 30 days' written notice. Upon termination:

  • Client access will be disabled
  • Data will be retained for 90 days for retrieval
  • All data will be permanently deleted thereafter, in accordance with our Refund and Cancellation Policy

9. Limitation of Liability

XHUMA is not liable for any indirect, incidental, or consequential damages arising from the use or inability to use our services. Total liability under any circumstance is limited to the amount paid by the Client for the previous 3 months of service.

10. Changes to Terms

We reserve the right to update these Terms of Service at any time. Continued use of our services constitutes acceptance of any revised terms.
